CDC vs DA Stormwater Requirements in NSW: What Certifiers Expect

Two Approval Pathways, One Set of Physics

Every new dwelling in NSW gets approved through one of two pathways: a Development Application (DA) assessed by council followed by a Construction Certificate (CC), or a Complying Development Certificate (CDC) issued by a council or private certifier under the State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 — the Codes SEPP. The rain falls the same on both, but the stormwater documentation each pathway demands is different, and builders who treat them interchangeably get caught out.

The CDC Pathway: Fixed Rules, No Discretion

Complying development trades flexibility for speed. The Codes SEPP sets development standards, and the certifier has no discretion to vary them — the proposal either complies or it cannot be approved as CDC. For stormwater, the key features are:

  • Lawful discharge is a threshold issue. The Housing Code requires stormwater to be disposed of to a public drainage system (such as kerb and gutter or a council drain), an inter-allotment drainage system, or another disposal arrangement approved by the relevant authority. If the lot cannot achieve this — common on low-side and rear lots — the CDC pathway may simply be unavailable until an easement or approved alternative is secured.
  • Technical compliance still applies in full. CDC construction must comply with the NCC, which references AS/NZS 3500.3:2021 for roof and surface stormwater drainage. “It’s only a CDC” does not reduce the engineering standard — it removes the council assessor, leaving the certifier to verify compliance from your documentation.
  • BASIX commitments — rainwater tanks and connected roof areas — must be shown and built as committed.
  • Council DCPs generally do not apply to CDC, but council requirements re-enter wherever you touch council assets: connecting to kerb and gutter, road openings, or works in the road reserve still need the relevant council approvals under other legislation.

What a CDC certifier typically expects to see: a stormwater/roof drainage plan showing catchments, gutter and downpipe sizing, the pipe layout, the nominated lawful discharge point, tank and overflow details, and enough levels to prove gravity actually works. Vague or conflicting drawings are the main cause of CDC stormwater hold-ups.

The DA Pathway: Council Discretion and the DCP Layer

A DA brings the council’s Development Control Plan into play, and DCP stormwater sections go well beyond the Codes SEPP:

  • On-site detention (OSD) — many councils require OSD for dual occupancies, multi-dwelling housing, and in some catchments even single dwellings, with permitted discharge rates and design storms set by the current DCP. Detention design typically follows methods consistent with Australian Rainfall & Runoff 2019.
  • Council-specific drainage rules — easement requirements, minimum pipe standards, overland flow path criteria, flood-related controls, and water quality measures on larger projects.
  • Conditions of consent — DA approvals routinely condition detailed stormwater design approval before CC issue, positive covenants over OSD, and works-as-executed documentation at completion.

At CC stage, the certifier checks the stormwater design against both the NCC/AS/NZS 3500.3:2021 and the DA conditions. A design that satisfies the standard but ignores a consent condition will not get a CC.

Choosing the Pathway: Stormwater Can Decide It

Drainage feasibility is one of the most common reasons a project that “fits” CDC on setbacks and height still cannot proceed as complying development:

  • No gravity fall to the street and no existing inter-allotment easement — CDC stalls until the easement is negotiated and registered.
  • Downstream capacity or flooding constraints that a council might resolve through DA conditions have no flexible mechanism under CDC.
  • Conversely, where a DCP imposes heavy OSD requirements, a compliant CDC proposal may avoid that layer entirely — a genuine cost difference worth checking at feasibility.

Because DCPs and council practices differ and are updated regularly, always confirm the current local requirements for the specific site before committing to a pathway.

Documentation Checklist for Either Pathway

  • Roof drainage sized to AS/NZS 3500.3:2021 with overflow provisions.
  • Site drainage layout with pipe sizes, grades and levels.
  • Nominated lawful point of discharge, with easements identified where needed.
  • BASIX tank integration with overflow routing.
  • For DA jobs: OSD design and compliance with each drainage condition of consent.
