Pool Drainage, Backwash and Stormwater: NSW Compliance Guide

A swimming pool is, hydraulically speaking, a large tank of chemically treated water sitting in your backyard, surrounded by hard paving, uphill or downhill of your house and your neighbours. Almost everything about it interacts with drainage: the backwash from the filter, the water when the pool is emptied, the overflow in a storm, the paved surrounds shedding runoff, and the excavation itself changing how the site drains.

NSW has clear rules about where each kind of pool water may go — and the central rule surprises many owners: treated pool water belongs in the sewer, not the stormwater system. Get the plumbing wrong and you are polluting waterways; get the surrounds drainage wrong and you are flooding your own house or your neighbour’s. This guide covers the compliance picture for pool drainage in NSW, from approval to the day-to-day operation of the filter.

The golden rule: chlorinated water goes to the sewer

Stormwater systems discharge, untreated, to creeks, rivers and the harbour. Pool water carries chlorine or salt-chlorinated water, filter contaminants and other chemicals that damage aquatic ecosystems. That is why the framework — Sydney Water’s requirements, the plumbing rules under the Plumbing and Drainage Act and AS/NZS 3500, and the pollution offences under the Protection of the Environment Operations Act 1997 — points the same way:

  • Filter backwash must discharge to the sanitary drainage system (the sewer), through a proper connection with the required air gap — not to the stormwater pipe, the street gutter, or over the garden fence.
  • Pool emptying water likewise goes to the sewer, at a controlled rate so the house drainage and Sydney Water’s system are not overwhelmed. Sydney Water publishes guidance on draining pools; in sewered areas, sewer disposal is the default position, and discharging pool water to the street is a pollution risk that councils can and do fine.
  • Discharging pool water to stormwater or a waterway can constitute water pollution under the POEO Act — an offence attracting penalty notices from councils and substantially higher penalties on prosecution. “It’s just a bit of pool water” is not a defence the legislation recognises.

In unsewered areas, different rules apply — councils specify on-site disposal methods, typically involving dechlorination, settling and controlled dispersal within the lot. Check your council’s requirements if you are not connected to sewer.

Backwash plumbing: the details that get inspected

Backwash disposal is licensed plumbing work, installed to AS/NZS 3500.2 and the NSW plumbing framework. The recurring compliance points:

  • Connection to the sanitary drainage system at an approved fixture or connection point, with an air gap so the pool circulation system cannot cross-connect with the sewer;
  • Discharge rate compatibility — the backwash flow must not exceed what the house drainage can carry, which matters for high-flow filters;
  • No “temporary” hose arrangements — a backwash hose run to the lawn or gutter each week is a non-compliance, not a workaround. Cartridge filters, which are cleaned rather than backwashed, sidestep much of this and are worth considering at selection stage;
  • Saltwater pools are not exempt — salt-chlorinated water is still chlorinated water with elevated salinity; it goes to the sewer like the rest.

Overflow and storm events: pools in the stormwater picture

What happens when a major storm fills the pool beyond its waterline? Well-designed pools handle this passively:

  • Freeboard and overflow path. The pool’s coping level and surrounding surface levels should direct storm overflow to a safe drainage path within your site — not over the neighbour’s boundary and not against the house. Rainwater diluted pool overflow in a storm is treated as part of site stormwater in practice; the design point is controlling where it flows.
  • Surrounds drainage. Pool paving is impervious catchment. Grated drains or falls collecting the surrounds to the site stormwater system keep chlorinated splash-out and rain runoff from ponding or sheeting to adjoining land. Councils assess this as part of the pool’s stormwater plan.
  • Pools on sloping sites. A pool cut into a slope intercepts overland flow from upslope. Diversion drains above the pool, and careful attention to retaining and batter drainage, stop the pool becoming a sediment trap in the first storm and a source of concentrated flow to the downhill neighbour thereafter.
  • Do not connect the pool to the stormwater system as a disposal route — the overflow path is a surface-level design matter; the piped stormwater system carries rainwater from roofs and surfaces, not pool water.

Approvals: how pools get consent in NSW

Swimming pools are approved through the same pathways as other residential work:

  • Complying development — many domestic pools qualify as complying development under the Codes SEPP where they meet the prescribed standards (location, setbacks, excavation limits and the rest), certified by a council or private certifier;
  • Development application — required where the site or design falls outside the standards, including many flood-affected, heritage or environmentally constrained sites;
  • Ancillary approvals — pool fencing under the Swimming Pools Act 1992 (a safety regime with its own registration and certification requirements), plumbing approvals for the backwash connection, and — easily missed — building over or near sewer assessment where the pool or its excavation encroaches on Sydney Water assets. A pool dug next to a sewer main without approval is an expensive conversation.

The stormwater component of the approval typically requires a drainage plan showing surrounds drainage, overflow path, backwash connection to sewer and — on sloping or constrained sites — how excavation spoil, dewatering during construction and altered flow paths are managed.

Construction-phase drainage: the forgotten fortnight

Between excavation and handover, a pool shell is a hole in the ground during Sydney’s storm seasons. Practical obligations during the build:

  • Erosion and sediment control — sediment fencing and controlled dewatering, because pumping muddy excavation water to the street is a POEO Act offence just like pumping pool water;
  • Dewatering groundwater — excavations intercepting groundwater need disposal arrangements (and the empty-shell buoyancy question answered structurally: hydrostatic relief valves exist because shells float);
  • Protecting the overland flow path — spoil heaps blocking the site’s natural drainage path have flooded more than one neighbour mid-build.

Emptying an existing pool: the right way

Renovating, repairing or removing a pool means disposing of the full volume. The compliant sequence: check whether your water authority requires a permit or has guidance for draining (Sydney Water’s position is that pool water goes to the wastewater system, discharged at a controlled rate via the sewer connection); stop dosing chemicals in advance; and never discharge to the street, stormwater pit or bushland. For pool removal, backfilling and demolition have their own approval and compaction requirements — and the site’s drainage pattern changes again when the pool stops intercepting its catchment.

  • Pool builder — shell, hydraulics and circulation plumbing;
  • Licensed plumber — backwash connection to sewer under the plumbing framework;
  • Civil/stormwater engineer — surrounds drainage, overflow path, overland flow and slope drainage design, and the stormwater documentation for the approval;
  • Certifier/council — approval, inspections and the pool safety certification regime;
  • You — ongoing operation: backwashing to sewer, maintaining surrounds drains, and not draining the pool onto the street the day before settlement.

Frequently asked questions

Can I backwash my pool filter onto the garden?

No — in sewered areas, backwash must discharge to the sewer through a compliant plumbing connection. Chlorinated water harms plants and soil biology, and runoff reaching the street or stormwater system is water pollution under the POEO Act. If your filter is a cartridge type, rinse water volumes are small, but the disposal principle is the same: keep treated water out of stormwater.

Where does pool overflow go in heavy rain?

Storm overflow should follow a designed surface path within your site to the stormwater drainage system — controlled by coping levels, surrounds falls and grated drains — rather than sheeting onto neighbouring land. The pool itself is not piped to stormwater; the surrounds drainage handles the storm case.

Do I need council approval for pool drainage specifically?

Drainage is assessed within the pool’s approval (CDC or DA): expect to show surrounds drainage, the overflow arrangement and the backwash connection. Separate to that, the backwash plumbing must be installed by a licensed plumber to AS/NZS 3500.2, and building near Sydney Water assets needs its own clearance.

Is saltwater pool water safe to discharge to stormwater?

No. Salt-chlorinated pools produce chlorinated, saline water — both properties are harmful to freshwater ecosystems. It is treated the same as any other pool water: to the sewer, at a controlled rate, or per your council’s unsewered-area requirements.
