Most Sydney councils respond by requiring on-site stormwater detention (OSD) once impervious area increases beyond a threshold, and a duplex almost always clears it.

Councils in the Parramatta and Hills districts commonly reference the UPRCT On-Site Stormwater Detention Handbook method, which produces a permissible site discharge (PSD) and a site storage requirement (SSR) for the lot. Other councils publish their own discharge rates or require pre- versus post-development flow matching across a range of storm events. The method varies; the outcome is similar. Builders sometimes assume “stormwater plan” means a single drawing with some pipes on it. For a duplex DA or CDC in Western Sydney, a complete package typically covers:

  • Site stormwater drainage plan — roof and surface drainage for both dwellings, pipe sizes and grades, pits, connection to the lawful point of discharge, and overland flow paths for storms that exceed the pipe system.

If the lot is later split under Torrens title, a shared OSD sitting on one of the new lots needs easements and maintenance obligations formalised so both owners remain responsible for it. Under strata, the OSD typically sits on common property and the owners corporation maintains it, which is administratively cleaner.

Separate systems for each dwelling cost more upfront but make Torrens subdivision straightforward: each lot carries its own detention, its own covenant, its own outlet. If your exit strategy is to sell two Torrens-titled dwellings to separate buyers, raise this with your engineer at concept stage. Retrofitting independence into a shared design after DA approval is expensive and sometimes physically impossible.

Above-Ground or Below-Ground Storage?

Above-ground detention — a depressed lawn or courtyard designed to pond briefly in major storms — is the cheapest storage you will ever build. The problem on duplex sites is space. Two dwellings on a standard lot rarely leave enough landscaped area at the right level to hold the full site storage requirement, and councils limit ponding depths in trafficable and recreational areas.

Most Western Sydney duplexes end up with a below-ground tank, usually under the driveway. That works, but it has consequences worth pricing in: a trafficable lid rated for vehicle loads, access grates for maintenance, screens on the orifice, and enough cover for the driveway pavement. Excavating into Western Sydney clay is straightforward; excavating into saline groundwater in parts of the Cumberland Plain needs more thought about tank materials and durability. Flag salinity early if the council’s mapping shows it.

The Outlet Is the Whole Game

Detention only works if water can leave the site at a controlled rate to a lawful point of discharge. On a flat Western Sydney block, achieving gravity fall from a rear dwelling, through a tank, to the street kerb can consume every millimetre of available grade. Get the outlet level surveyed before the dwelling floor levels are set — nothing unwinds a duplex design faster than discovering, post-DA, that the rear dwelling cannot reach the street by gravity.

Western Sydney Site Realities

Duplex stormwater in Western Sydney comes with a set of recurring physical constraints that shape almost every design:

  • Clay soils. Cumberland Plain clays infiltrate poorly. Absorption trenches and infiltration-based disposal that might pass elsewhere generally will not satisfy council here. Assume piped discharge is required.
  • Salinity. Parts of Western Sydney are mapped for salinity hazard. This affects concrete tank specification, pipe materials and sometimes the acceptability of infiltration.
  • Flat grades. Many suburbs sit on gentle terrain where the street kerb is barely lower than the rear of the lot. Every junction, bend and pit costs fall. Long, flat pipe runs need careful design to stay self-cleansing and buildable.
  • Rear dwelling discharge. On a detached duplex with a rear dwelling, the back unit’s stormwater has to travel the full depth of the lot to reach the street — or leave through the rear boundary via an inter-allotment drainage easement across a neighbouring property. If the block falls away from the street, an easement or a pump-out system may be the only options, and easement negotiations with neighbours take time and money that must be in the feasibility from day one.
  • Limited street drainage. Older release areas often have kerb-and-gutter only, with the nearest drainage pit a long way off. Councils differ on whether kerb discharge is acceptable for duplex flows or whether you must pipe to a pit.

Attached Versus Detached Duplexes

An attached, side-by-side duplex is usually the kinder configuration for drainage. Both dwellings front the street, both roofs can drain forward, the OSD can sit under the shared driveway near the frontage, and the whole system stays short and shallow. Roof drainage to AS/NZS 3500.3:2021 — gutters, downpipes and overflow provisions — is straightforward to detail.

A detached front-and-rear configuration puts the second dwelling deep in the lot, which lengthens pipe runs, consumes grade, complicates the overland flow path and raises the easement question if the land falls to the rear. A long side driveway is also a significant catchment in its own right. Neither layout is wrong, but the detached form carries more stormwater risk and deserves an engineering sanity check before the design is committed.

Subdivision: Where Shared Drainage Bites Later

Most duplex projects intend to subdivide, either Torrens or strata, after construction. Drainage is one of the main things that determines how painful that step is.

Under Torrens subdivision, each new lot must have lawful, independent access to a point of discharge — or formalised easements over the other lot for shared pipes and shared OSD. A shared tank on Lot 1 serving Lot 2 needs an easement to drain water plus maintenance and access arrangements, on top of the standard positive covenant obliging owners to maintain the OSD; with a shared system, that covenant machinery gets more involved.

Under strata subdivision, shared drainage and OSD normally become common property, maintained by the owners corporation. This suits shared systems well, but buyers and their conveyancers increasingly ask about OSD maintenance obligations, so clean documentation still matters.

The practical advice: decide your subdivision pathway before the stormwater design is finalised, and tell your engineer. The right OSD configuration for a strata duplex is often the wrong one for a Torrens pair.

Sequence It Properly: Concept Before Layout

The single cheapest risk-reduction step on any duplex project is a stormwater concept prepared before the architectural site layout is locked. A concept-stage review — survey levels, point of discharge, indicative OSD volume and location, easement risk, flood and overland flow check — costs a fraction of redesigning a DA package after council raises the problems for you. It tells the designer where the tank has to go, whether the rear dwelling can drain by gravity, and whether the feasibility needs an allowance for an easement or pump system. Builders who do this once rarely go back; the alternative — a stormwater plan reverse-engineered around a finished architectural layout — is where RFIs, redesign fees and lost months come from.

What Certifiers Check at CC and OC

Whether the duplex is approved by DA or as complying development, the private certifier is the gatekeeper on stormwater at two points.

Before the Construction Certificate, the certifier will want the detailed stormwater design consistent with the DA consent or CDC conditions: OSD calculations to the council method, pipe design, and any conditions about easements or covenants addressed. If the consent required an inter-allotment easement, expect to show it registered or at least secured before CC — this is a classic late-stage holdup.

Before the Occupation Certificate, expect scrutiny of the built system: an engineer’s OSD certification confirming construction in accordance with the approved design, a works-as-executed (WAE) survey showing as-built levels, storage volume and orifice details, and evidence that the positive covenant for OSD maintenance is registered on title. Certifiers have tightened on this — a duplex with tenants ready to move in will not get its OC while the WAE shows the tank was built under volume or the covenant paperwork is missing. Build these steps into the construction program: the engineer needs to inspect the tank and orifice before they are buried, not be handed photos after the driveway is poured.
