Erosion & Sediment Control Plans NSW
Every construction site sheds soil the moment the first scrape of topsoil comes off, and NSW regulators take a hard line on where that soil ends up. An erosion and sediment control plan – the ESCP – is the document that shows council or the certifier exactly how you will keep sediment on site and out of gutters, drains and waterways for the life of the works. It is one of the most frequently requested documents in the NSW approval system, and one of the easiest to get wrong: a generic plan lifted from a template will bounce back from council, while a plan that ignores how the builder actually stages the job will be ignored on site.

When council requires it
An ESCP is required as a matter of routine wherever soil is disturbed. Councils call for it with development applications involving earthworks, demolition or construction; certifiers require it before issuing a construction certificate or complying development certificate; and conditions of consent almost universally require erosion and sediment controls to be installed before works commence and maintained until the site is stabilised. Under the Protection of the Environment Operations Act, allowing sediment-laden water to leave a site can attract on-the-spot penalties, so the plan is not paperwork for its own sake – it is the site’s defence against pollution notices.
Larger disturbances carry heavier obligations. Where the disturbed area is significant – thresholds are set by legislation and council policy – a more detailed soil and water management plan may be required, with staged controls, sediment basin sizing and site-specific soil loss assessment. We prepare documentation at both levels and will tell you honestly which tier your project sits in.

Software & standards
Our ESCPs are prepared in accordance with Managing Urban Stormwater: Soils and Construction – Volume 1 (Landcom), the manual known across the NSW industry as the Blue Book, which remains the benchmark councils and certifiers assess against. Rainfall erosivity and design storm inputs draw on ARR 2019 data, and where sediment basins or diversion works interact with the permanent drainage system we model that interaction in DRAINS. Plans are formatted to the requirements of the relevant council DCP and engineering specification – including AUS-SPEC-based council specifications where adopted – so the drawing lands in the format the assessing officer expects. On sites where we are also delivering the stormwater or civil design, the erosion controls are coordinated directly with those drawings rather than sitting in a separate, contradictory set.

Frequently asked questions
Do I need an erosion and sediment control plan for a single dwelling or duplex in NSW?
Almost always, yes. Any development involving excavation, filling or construction disturbance will attract an ESCP requirement, either at DA stage or as a condition before the construction certificate or complying development certificate is issued. For small sites the plan is straightforward – typically a single sheet – but it must still be site-specific: certifiers increasingly reject generic diagrams that do not reflect the actual driveway location, fall of the land or stockpile areas.
What is the difference between an ESCP and a soil and water management plan?
An ESCP is the standard drawing-plus-notes document suited to most building sites. A soil and water management plan (SWMP) is the more detailed tier required for larger disturbed areas, applying Blue Book methodology in depth – soil loss assessment, sediment basin design, staging plans and a management framework for the duration of the works. The threshold between them depends on the disturbed area and the consent conditions; we confirm which applies before quoting.
Who is responsible if sediment leaves the site during construction?
Responsibility sits with those carrying out and controlling the work – typically the builder and the owner – and NSW councils and the EPA can issue penalty notices or clean-up directions when sediment pollutes gutters, drains or waterways. A competent, current ESCP that is actually implemented on site is the practical protection: it demonstrates the controls that should be in place and gives the site team a clear standard to maintain, especially before forecast rain.
How quickly can an ESCP be prepared for a CC or CDC lodgement?
For a standard residential or small commercial site with survey and site plans already available, an ESCP is one of the quicker documents in the approval set, and we routinely prioritise them when a lodgement is waiting on the plan.
