Bushfire-Prone Land: APZs, Access & Water for Rural Builds

If you are planning a home, shed or subdivision on rural land in NSW, there is a fair chance the site is mapped as bush fire prone. That single notation on a planning certificate changes how your building must be constructed, how far it must sit from vegetation, how your driveway must be built, and how much water you need to store on site for firefighting. Get across those requirements early and they become design inputs. Discover them after you have positioned the house and priced the build, and they become expensive surprises.

This guide explains the NSW bushfire planning framework and the part most people underestimate: the civil engineering. APZs, access roads and water supply are as much earthworks-and-drainage problems as bushfire problems, and smart civil design can genuinely reduce construction cost.

How bushfire-prone land is identified in NSW

Bush fire prone land in NSW is mapped by local councils and certified by the NSW Rural Fire Service (RFS) Commissioner. The maps identify vegetation categories and buffer areas around them. The quickest way to find out whether a property is affected is the section 10.7 planning certificate from council, which must state whether the land is bush fire prone.

If the land is mapped, development must comply with Planning for Bush Fire Protection 2019 (PBP 2019), which has been in force since 1 March 2020. PBP 2019 is the RFS’s design bible for development on bush fire prone land. It works through a suite of protection measures that operate together:

  • Asset protection zones (APZs) — fuel-reduced buffers between buildings and hazard vegetation.
  • Building construction standards — BAL ratings under AS 3959 that dictate construction detail.
  • Access arrangements — roads and driveways that let residents leave and firefighters get in.
  • Water supply — reticulated or static water for firefighting.
  • Emergency management and landscaping — evacuation arrangements and vegetation choices near buildings.

The important mindset shift is that these measures trade off against each other. A more generous APZ can lower the required construction standard; a constrained lot with no room for an APZ pushes the building standard up. That interplay is where good site planning earns its keep.

Asset protection zones: your first line of defence

An APZ is a managed, fuel-reduced area between the building and the bushfire hazard. It is not necessarily cleared bare — it is maintained so that fuel loads stay low, tree canopies are separated, and fire approaching the building loses intensity. The required APZ width depends on three things:

  • Vegetation formation — forest demands more separation than woodland, which demands more than grassland.
  • Effective slope — fire runs faster and burns hotter uphill, so land falling away below the vegetation increases the required APZ.
  • Fire danger index for the region — a measure of how severe fire weather can get in that part of NSW.

Two rules of thumb follow. First, the APZ must generally be contained within your own property — you cannot rely on managing the neighbour’s paddock or the adjoining reserve. Second, the APZ is a commitment that runs with the development for its life: it has to be maintained, not just established for the inspection.

BAL ratings and what they cost you

The Bush fire Attack Level (BAL) describes the severity of exposure a building is designed to withstand, and it drives construction requirements under AS 3959. The categories run from BAL-LOW through BAL-12.5, BAL-19, BAL-29, BAL-40 and up to BAL-FZ — the flame zone, where the building may be exposed to direct flame contact. Each step up brings more demanding construction: ember protection, toughened glazing, sealed gaps, non-combustible external materials and more. As a rule, the higher the BAL, the costlier the build — and at BAL-FZ, both cost and approval difficulty rise sharply.

Because BAL is a function of distance from vegetation, slope and vegetation type, it is partly within your control. Move the building envelope further from the hazard, or place it upslope rather than downslope of vegetation, and the BAL drops. This is exactly where civil design enters the picture.

The civil engineering angle: siting, earthworks and grades

On a rural lot, the house pad and driveway are usually the two biggest civil items, and both interact with bushfire requirements.

  • Siting the pad to reduce BAL. A pad located to maximise separation from forest edges — and to avoid sitting at the top of a vegetated downslope — can bring a build down one or two BAL categories. The construction saving often outweighs the cost of a longer driveway or extra earthworks.
  • Earthworks and driveway grades. PBP 2019 expects property access to avoid excessive grades so a fire appliance can climb the driveway safely. On steep lots, that can mean benching the driveway across the contour, longer alignments and cut-and-fill batters that need drainage and stabilisation.
  • Combining bushfire and stormwater requirements. The same driveway that must carry a fire truck also concentrates runoff; table drains, culverts and scour protection have to be designed for both jobs. APZ areas also need to be trafficable and maintainable, which means thinking about grades and drainage inside the APZ too.

Access: getting a fire truck to the house

Long rural driveways are one of the most common sticking points in bushfire assessments. PBP 2019 sets standards for property access roads because, in a fire, the driveway is both the resident’s escape route and the fire brigade’s supply line. The recurring themes are:

  • All-weather construction — the surface must remain usable in wet conditions, which typically means a properly built gravel or sealed pavement, not a graded dirt track.
  • Load capacity — the pavement, and any bridges or causeways along the route, must carry a firefighting appliance. An old farm crossing that handles a ute may not satisfy the RFS.
  • Passing bays — on long, narrow driveways, vehicles must be able to pass each other so residents leaving do not meet a fire truck arriving with nowhere to go.
  • Turning areas — fire appliances need to turn around at the house end rather than reverse out over a long distance.
  • Grades and geometry — excessive steepness, tight curves and poor sight lines all draw comment; the alignment needs to suit a heavy truck, not just a car.

Culverts and creek crossings deserve special mention. A crossing rated for fire appliances is a genuine structural design task: pipe or box culverts with adequate cover, sound headwalls, and a deck or pavement designed for the load. If your access crosses a drainage line, budget for engineering input on the crossing — it is usually the most expensive single element of a rural driveway and the one most likely to be queried.

Water supply: static water for firefighting

Where reticulated town water is available, hydrants generally cover the firefighting supply. On most rural lots there is no reticulated supply, so PBP 2019 requires a dedicated static water supply — in practice, one or more tanks (or in some cases dams or pools, subject to requirements) reserved for firefighting, fitted with fire brigade connections so an appliance can draw from them. The required capacity depends on the type and scale of the development, so treat it as a design input rather than guessing a tank size.

The civil considerations are practical ones:

  • Tank placement — close enough to the building to be useful, and accessible so a fire appliance can reach the fittings without complicated manoeuvring.
  • Hardstand — the appliance needs somewhere firm and level to stand while drafting, which means a designed hardstand area with pavement and drainage, not soft lawn.
  • Fittings — fire brigade couplings of the right type, kept clear and visible.
  • Integration with domestic supply — the firefighting reserve must be dedicated, so it is commonly the bottom portion of a larger tank with the domestic draw-off set higher, or a separate tank altogether.

The 10/50 scheme: what it is and what it is not

The 10/50 Vegetation Clearing Scheme, introduced in 2014 under the Rural Fires Act, allows owners in mapped 10/50 entitlement areas to clear trees within 10 metres of an external wall of a home, and vegetation other than trees within 50 metres, without a separate approval. Two cautions apply. First, always check the RFS online tool before clearing — the entitlement areas and the code have been revised since the scheme began, and clearing outside an entitlement area or outside the code can be unlawful. Second, 10/50 is a maintenance tool for existing homes. It is not a substitute for a properly assessed APZ in new development, and you cannot rely on it to justify a smaller APZ in a DA.

Approval pathways: single dwellings versus subdivisions

The assessment pathway depends on what you are building:

  • Single dwellings and alterations on bush fire prone land need a bushfire assessment lodged with the DA, demonstrating compliance with PBP 2019 — the APZ, BAL, access and water package described above.
  • Subdivisions and special fire protection purpose developments — schools, aged care facilities, tourist accommodation and similar uses where occupants may be vulnerable or unfamiliar with the area — are integrated development. They require a bush fire safety authority from the NSW RFS under section 100B of the Rural Fires Act, which means the RFS is a formal approval body, not just a commenter.

For subdivisions, this elevates bushfire from a lot-scale question to a layout question: road networks, perimeter roads between lots and hazard vegetation, APZs achievable within each lot, and water supply for the whole estate all need to be resolved in the subdivision design. Retrofitting bushfire compliance into a layout drawn without it rarely ends well.

Getting the sequence right

For a rural build, a sensible order of operations looks like this:

  • Obtain the 10.7 certificate and confirm whether the land is bush fire prone.
  • Get a bushfire assessment early to establish vegetation formations, effective slopes, indicative APZs and BAL contours across the site.
  • Use that information to site the house pad and driveway — trading APZ width, BAL rating, earthworks and access cost against each other.
  • Design the civil package — pad, driveway, crossings, stormwater, tank hardstand — as one integrated exercise.
  • Lodge the DA with the bushfire assessment and civil drawings telling the same story.

Handled this way, bushfire compliance stops being a hurdle at the end and becomes one of the inputs that shapes a safer, cheaper, more buildable design.

No. The 10/50 Vegetation Clearing Scheme is a maintenance entitlement for existing homes in mapped entitlement areas — it lets owners clear trees within 10 metres and other vegetation within 50 metres of an external wall without approval, subject to the code. It does not replace the APZ assessment required for new development, and you should always check the RFS online tool before clearing because entitlement areas and the code have been revised.

When does the RFS have to approve my development directly?

Subdivisions of bush fire prone land and special fire protection purpose developments — such as schools, aged care and tourist accommodation — are integrated development.
