When council requires it
Strictly, it is the water authority as much as the council doing the requiring — but the two are stitched together through the consent. Conditions of development consent for subdivisions and most multi-dwelling projects in the Sydney Water area require a Section 73 certificate before a subdivision certificate or occupation certificate can be issued. Councils outside metropolitan Sydney, acting as the local water utility, impose equivalent conditions requiring certificates of compliance for water supply and sewerage works under their own developer processes.
Beyond the certificate itself, councils and certifiers routinely ask for servicing evidence earlier in the process: a servicing strategy or utility feasibility statement at DA stage demonstrating that water and sewer can reach every proposed lot, easements for any infrastructure crossing private land, and coordinated engineering plans showing water and sewer alongside roads, stormwater and other utilities. Software & standards
Reticulation design in the Sydney Water area is prepared to Sydney Water’s technical requirements as applied through its accredited provider framework; in regional NSW we design to the standards each local water utility has adopted, which are commonly based on the Water Services Association of Australia codes with local amendments. Internal property services and the interface at the point of connection are designed to AS/NZS 3500.3:2021 principles alongside the plumbing standards applying to the water and sanitary components. What is a Section 73 certificate and why does my subdivision need one?
A Section 73 compliance certificate is Sydney Water’s confirmation, issued under the Sydney Water Act 1994, that a development has met its water and wastewater servicing obligations — which may range from a simple connection through to designing and constructing new mains. Development consents in the Sydney Water area routinely make it a precondition to the subdivision certificate or occupation certificate, so registration and settlement cannot occur without it. How early should water and sewer servicing be investigated on a development site?
At due diligence — before purchase if possible, and certainly before the layout is fixed. What happens if an existing sewer main runs through my development site?
Existing mains constrain building placement: authorities protect their assets with requirements around building over or adjacent to mains, and structures encroaching on them may trigger adjustment, encasement or deviation works designed and approved through the authority’s process. It is a solvable problem — we regularly design around, over and occasionally through these constraints — but it must be identified early, because relocating a sewer after the architecture is resolved is expensive in every currency a project has.
