If you are subdividing land in NSW, telecommunications infrastructure is not an optional extra — it is a condition of getting your subdivision registered. Under Commonwealth policy for new developments, developers are responsible for providing fibre-ready facilities, better known as pit and pipe, for every new lot they create. Why developers are responsible for pit and pipe
Since the rollout of the National Broadband Network, Australian Government policy on telecommunications in new developments has placed the responsibility for on-site infrastructure squarely with the developer. In simple terms, NBN Co (or another carrier) will bring its network to your development, but you must provide the underground pathway that lets them do it — the pits, the conduits and the lead-ins to each lot or dwelling.
This means the developer must organise, fund and construct fibre-ready facilities for all new lots, buildings or units in a development. For a subdivision creating new roads or shared driveways, that translates to a fully reticulated underground network of communications pits and conduits connecting every lot back to the point where NBN Co’s network enters the estate.

- Draw ropes, markers and spacing provisions — the details that make the network usable: haul ropes in every conduit, correct cover depths, clearances from other services, and marker tape so the asset can be located later.
The design must also respect the rest of the civil works. Conduit alignments have to coordinate with stormwater drainage, sewer, water, gas and electrical reticulation, driveway crossovers and street trees. The NBN Co process, step by step
The practical process for a subdivision runs broadly as follows. The exact pathway depends on the size and type of development, but the sequence is consistent.
1. Check eligibility and lodge the application
The first step is an online eligibility check with NBN Co, followed by a formal New Developments application. The developer is usually the applicant, though you can nominate an authorised representative — many developers have their telecommunications consultant lodge and manage the application on their behalf. Early is better: NBN Co recommends applying well before construction so assessment and design review do not sit on your critical path.
2. Assessment and conditional approval
NBN Co assesses the application, confirms any applicable charges and provides an indicative timeframe. Once terms are accepted, NBN Co issues a letter of conditional approval — sometimes called a provisioning or council letter — which is the document many NSW councils ask to see as evidence that telecommunications servicing has been arranged. Applications are then managed through the NBN New Developments Portal, which tracks the tasks you need to complete on the way to the estimated ready-for-service date.
3. Design preparation and review
The developer’s designer prepares the pit and pipe design in accordance with NBN Co’s design and construction specifications for new developments. The design shows pit locations and types, conduit sizes and routes, lead-ins to every lot, and how the network ties into NBN Co’s existing infrastructure at the development boundary. NBN Co reviews and provides feedback on the design; construction should not start on the communications works until the design documentation is accepted.
4. Construction and certification
The pit and pipe is installed as part of the civil works — usually in the same trenching program as the other utilities, which is far cheaper than mobilising separately. On completion, the works are inspected and certified. For the subdivision certificate you will need both a design compliance certificate and an as-built (work-as-executed) compliance certificate confirming the installed infrastructure matches the accepted design and complies with the current industry guidelines.
5. Ownership transfer and fibre deployment
Before NBN Co deploys its fibre, the developer transfers ownership of the pit and pipe network to NBN Co (or grants the necessary licence) under the development agreement. NBN Co then hauls cable, completes the connection to its network and declares the development ready for service — at which point purchasers can order retail services from a provider of their choice.
Where subdivisions go wrong
Most pit and pipe problems are process problems, not construction problems. The recurring ones we see across NSW projects:
- Applying too late. The NBN application, design review and agreement steps take time. Developers who first think about telecommunications when the linen plan is being prepared discover the subdivision certificate is now hostage to a process that should have started months earlier.
- Uncoordinated service trenches. Communications conduits installed without reference to the civil design end up clashing with stormwater lines, sitting under future driveways, or breaching clearance requirements — all of which show up at the as-built inspection.
- Missed lead-ins. Every lot needs its own lead-in provision. Corner lots, battle-axe lots and lots fronting shared driveways are the usual casualties. Retrofitting a lead-in after the verge is landscaped and the driveway poured is painful and expensive.
- Non-compliant installation. Insufficient cover depth, missing draw ropes, wrong pit types, crushed or blocked conduits. If the certifier cannot verify compliance, you do not get your as-built certificate — and without it, no subdivision certificate.
- Assuming the electrician or plumber “will sort it”. Pit and pipe is a designed, certified network with its own standards. Treating it as incidental trenching is the fastest route to rework.
Timing pit and pipe within your project program
The sensible sequence for a NSW subdivision looks like this: engage the telecommunications designer around the time civil design starts; lodge the NBN application before or alongside your construction certificate package; have the accepted pit and pipe design issued for construction with the civil drawings; install conduits in the common utility trench; and book the compliance inspection as trenches are progressively backfilled rather than after everything is buried.
